Always remember police do not file charges. Police only recommend to the prosecuting attorney if charges should be filed. The police are advising the prosecuting attorney they believe there is enough sufficient evidence (probable cause) to proceed with charges and convict the suspect.
Victims do not have the power to press or drop charges. The only entity that has the authority to bring criminal charges is the prosecuting attorney’s office.
Pertaining to juvenile cases, the probation department is very instrumental in the decision as to whether or not to charge the defendant.
